{"id":7612,"date":"2024-03-09T16:00:40","date_gmt":"2024-03-09T21:00:40","guid":{"rendered":"https:\/\/pierreroy.com\/?p=7612"},"modified":"2024-03-23T12:58:47","modified_gmt":"2024-03-23T17:58:47","slug":"weppa-wage-earner-protection-program-who-is-entitled-to-what","status":"publish","type":"post","link":"https:\/\/pierreroy.com\/en\/2024\/03\/weppa-wage-earner-protection-program-who-is-entitled-to-what\/","title":{"rendered":"Wage Earner Protection Program: Who Is Entitled to What?"},"content":{"rendered":"<p>The <strong>Wage Earner Protection Program (WEPP)<\/strong> is a federal program administered by Service Canada with the aim of assisting workers whose employer is bankrupt or subject to receivership.<!--more--><\/p>\n<p>The program, which came into effect in 2008, provides benefits to workers owed amounts for &#8220;eligible wages.&#8221; It offers protection to workers and mitigates the negative impact of sudden job loss.<\/p>\n<h2>Who Is Eligible for the Wage Earner Protection Program?<\/h2>\n<p>The following conditions must be met for a worker to be eligible for WEPP benefits:<\/p>\n<ul>\n<li>The employer is bankrupt or subject to receivership;<\/li>\n<li>The employment of the worker has ended;<\/li>\n<li>The employer owes wages to the worker;<\/li>\n<li>The unpaid wages were earned during the 6-month period preceding bankruptcy, receivership, or a previous restructuring procedure.<\/li>\n<\/ul>\n<p>There are some exceptions to the above conditions. The following individuals would not be eligible for WEPP benefits:<\/p>\n<ul>\n<li>An officer or director of the employer;<\/li>\n<li>Someone who had control of the employer&#8217;s affairs (e.g., someone with over 40% voting rights by shareholding);<\/li>\n<li>Someone who held a managerial position with the employer;<\/li>\n<li>Someone with a dependency link to a person mentioned above.<\/li>\n<\/ul>\n<p>Note that it is possible for a worker with a dependency link to a person mentioned above to be eligible if they can demonstrate that the terms of their employment would have been the same without this dependency link. Also, a family relationship does not necessarily equate to a dependency link.
